POLÍTICA DE CÓDIGO ABIERTO

La RFJ provee acceso libre inmediato a su contenido bajo el principio de que hacer disponible gratuitamente investigación al público contribuye al mayor intercambio de conocimiento global.

Condiciones de auto-archivo: Se permite y promueve entre los autores y los lectores la reutilización de los trabajos publicados, es decir, se puede archivar el post-print (o la versión final posterior a la revisión por pares o la versión PDF del editor) incluyendo su depósito en repositorios institucionales, temáticos o páginas web personales. La RFJ permite que los/las autores/as posean el copyright sin restricciones.

 

IMPORTANTE:

1) En la RFJ, el texto completo de TODO el contenido está disponible para acceso completamente gratuito y abierto sin demora (es decir, sin período de embargo).
2) Puede existir un cargo por la versión impresa de la revista. Actualmente, la distribución de RFJ es solo en línea.
3) No es necesario registrarse en la RFJ para leer y compartir su contenido.
4) Invitamos a compartir y reutilizar el contenido de la RFJ en aras de democratizar el acceso al conocimiento científico-jurídico.

ARCHIVAR

La RFJ permite a las bibliotecas crear archivos permanentes de la revista con fines de preservación y restauración. Además, esta revista utiliza diferentes repositorios nacionales e internacionales, tales como Google Académico entre otros. Y el Repositorio Institucional de la PUCE (Ecuador) archivan digitalmente y garantizan a su vez la indización.

  

CONFLICTO DE INTERESES

Los autores deben declarar que no tienen ningún conflicto potencial o real de tipo financiero, personal o de cualquier í­ndole con otras personas u organizaciones en los siguientes dos años después de someter el artículo, que pueda influenciar negativamente el trabajo realizado. Ver la forma "Conflicto de Intereses" en Open Journal System.

 

CAMBIOS EN LA AUTORíA

Se refiere a la adición, remoción o re-acomodación del orden de los autores. Antes de que el artí­culo sea publicado, el autor para correspondencia puede solicitar al Editor, adicionar, remover o modificar el orden de los autores. Debe indicar la razón para hacer la modificación y enviar una comunicación escrita firmada por todos los autores certificando que todos están de acuerdo con la modificación. En caso de adición o remoción la comunicación escrita debe incluir la confirmación por parte del autor(es). Una vez publicado el artí­culo no se aceptan adición, remoción o modificación en el orden de los autores.

 

COSTOS DE PROCESAMIENTO Y ENVÍO DE ARTíCULOS

La RFJ es una publicación gratuita. La RFJ no realiza ningún cobro por la postulación, evaluación y publicación de los artí­culos sometidos. La publicación, no genera costo alguno para autores y lectores, toda vez que la PUCE asume los gastos relacionados con edición, gestión y publicación. Los pares evaluadores no reciben retribución económica alguna por su valiosa contribución.

 

DECLARACIÓN DE BUENAS PRÁCTICAS

Como se ha mencionado en la Declaración de Principios Éticos (Código de Ética), la RFJ está comprometida con altos estándares de ética y buenas prácticas en la difusión y transferencia del conocimiento, para garantizar el rigor y la calidad cientí­fica. Es por ello por lo que ha adoptado como referencia el Código de Conducta que, para editores de revistas cientí­ficas, ha establecido el Comité de Ética de Publicaciones (COPE: Committee on Publication Ethics) dentro de los cuales se destaca:

 

Obligaciones y responsabilidades generales del equipo editorial

La RFJ se compromete a:

• Aunar esfuerzos para satisfacer las necesidades de los lectores y autores.
• Propender por el mejoramiento continuo de la revista.
• Asegurar la calidad del material que se publica.
• Velar por la libertad de expresión.
• Mantener la integridad académica de su contenido.
• Impedir que intereses comerciales comprometan los criterios intelectuales.
• Publicar correcciones, aclaraciones, retractaciones y disculpas cuando sea necesario.

 

Relaciones con los autores

La RFJ se compromete a asegurar la calidad del material que publica, informando sobre los objetivos y normas de la revista. Las decisiones del editor para aceptar o rechazar un documento para su publicación se basa únicamente en la relevancia del trabajo, su originalidad y la pertinencia del estudio con relación a la lí­nea editorial de la revista.

La revista incluye una descripción de los procesos seguidos en la evaluación por pares de cada trabajo recibido. Cuenta con un manual de enví­o de manuscritos para autores en la que se presenta esta información y es actualizada regularmente. Se reconoce el derecho de los autores a apelar las decisiones editoriales.

El editor no modificará su decisión en la aceptación de enví­os, a menos que se detecten irregularidades o situaciones extraordinarias. Cualquier cambio en los miembros del comité editorial no afectará las decisiones ya tomadas, salvo casos excepcionales en los que confluyan graves circunstancias.

IMPORTANTE: Al postular sus artí­culos los autores deberán indicar su código ORCID.

 

Relaciones con los evaluadores

La RFJ pone a disposición de los evaluadores un manual para la evaluación de manuscritos acerca de lo que se espera de ellos. La identidad de los evaluadores se encuentra en todo momento protegida, garantizando su anonimato. 

 

Aspectos generales del proceso de evaluación por pares

La RFJ garantiza que el material remitido para su publicación será considerado como materia reservada y confidencial mientras que se evalúa (doble ciego).

 

RECLAMACIONES
La RFJ se compromete responder con rapidez a las quejas recibidas y a velar por que los demandantes insatisfechos puedan tramitar todas sus quejas. En cualquier caso, si los interesados no consiguen satisfacer sus reclamaciones, se considera que están en su derecho de elevar sus protestas a otras instancias.

 

FOMENTO DE LA INTEGRIDAD ACADÉMICA

La RFJ asegura que el material que publica se ajusta a las normas éticas internacionalmente aceptadas.

 

PROTECCIÓN DE DATOS INDIVIDUALES

La RFJ garantiza la confidencialidad de la información individual (por ejemplo, de los profesores y/o alumnos participantes como colaboradores o sujetos de estudio en las investigaciones presentadas).

 

Seguimiento de malas prácticas

La RFJ asume su obligación para actuar en consecuencia en caso de sospecha de malas prácticas o conductas inadecuadas. Esta obligación se extiende tanto a los documentos publicados como a los no publicados. El editor no sólo rechazará los manuscritos que planteen dudas sobre una posible mala conducta, sino que se consideran éticamente obligados a denunciar los supuestos casos de mala conducta. Desde la revista se realizarán todos los esfuerzos razonables para asegurar que los trabajos sometidos a evaluación sean rigurosos y éticamente adecuados.

 

 Integridad y rigor académico

Cada vez que se tenga constancia de que algún trabajo publicado contiene inexactitudes importantes, declaraciones engañosas o distorsionadas, debe ser corregido de forma inmediata.

En caso de detectarse algún trabajo cuyo contenido sea fraudulento, será retirado tan pronto como se conozca, informando inmediatamente tanto a los lectores como a los sistemas de indexación.

Se consideran prácticas inadmisibles, y como tal se denunciarán las siguientes: el enví­o simultáneo de un mismo trabajo a varias revistas, la publicación duplicada o con cambios irrelevantes o parafraseo del mismo trabajo, o la fragmentación artificial de un trabajo en varios artí­culos. 

 

Relaciones con los propietarios y editores de revistas

La relación entre editores, editoriales y propietarios estará sujeta al principio de independencia editorial. La RFJ garantizará siempre que los artí­culos se publiquen con base en su calidad e idoneidad para los lectores, y no con vistas a un beneficio económico o polí­tico. En este sentido, el hecho de que la revista no se rija por intereses económicos, y defienda el ideal de libre acceso al conocimiento universal y gratuito, facilita dicha independencia.

 

CONFLICTO DE INTERESES

La RFJ establecerá los mecanismos necesarios para evitar o resolver los posibles conflictos de intereses entre autores, evaluadores y/o el propio equipo editorial.

 

QUEJAS/DENUNCIAS
Cualquier autor, lector, evaluador o editor puede remitir sus quejas a los organismos competentes.

 

POLÍTICA DE ENDOGAMIA

A partir del quinto número los miembros del Comité Editorial, Equipo de Gestión Editorial, Consejo Editorial y Evaluadores Externos no podrán publicar en la RFJ. Para números anteriores, los miembros del Comité Editorial limitaron la publicación de manuscritos a uno (1) por volumen, cuando el editor es el primer autor del artí­culo y a dos (2), cuando es un autor secundario. Para un mismo autor, el lí­mite fue de una publicación por número, es decir máximo 4 publicaciones por volumen. Sin embargo, las publicaciones para autores afiliados a la Pontificia Universidad Católica del Ecuador - PUCE no superarán el 30% del total.

IMPORTANTE: Como se indica la RFJ cumple un estricto protocolo de prevención de endogamia (introducido en acatamiento de recomendaciones generales/políticas de la SENESCYT). Por este motivo, tampoco pueden participar en calidad de autores: 1) las autoridades de la Facultad; 2) aquellos que hayan ostentado un cargo directivo dentro de la unidad académica (Fac. de Jurisprudencia);  y 3) quellos que hayan ostentado la responsabilidad de las coordinaciones de investigación y/o publicaciones de la unidad académica (Fac. de Jurisprudencia). 

 

POLÍTICAS DE PRESERVACIÓN DIGITAL

La Revista se ajusta a las polí­ticas y lineamientos de la Dirección de Informática y del Sistema de Biblioteca General de la Pontificia Universidad Católica del Ecuador - PUCE.

 

 

CUOTA DE GÉNERO

De manera transversal para todos sus órganos, procesos y productos/secciones, la RFJ procura que esta no se sitúe por debajo del 50%.

 

AVISO LEGAL

En atención del amparo legal que brinda el Art. 118 del Código Orgánico de la Economía Social de los Conocimientos, Creatividad e Innovación (Código Ingenios) del número 1 al número 6 de la revista se ha respetado el formato original de los documentos/artículos remitidos.

 

OPEN CODE POLICY

The RFJ provides immediate free access to its content under the principle that making research freely available to the public contributes to the greater global exchange of knowledge.

Self-archiving: The reuse of published works is allowed and promoted among authors and readers. That is, the post-print can be archived (or the final version after peer review or the editor's PDF version ), including its deposit in institutional, thematic repositories or personal web pages. RFJ allows authors to own the copyright without restrictions.

IMPORTANT:

1) At the RFJ, the full text of ALL content is available for completely free and open access without delay (i.e., no embargo period).
2) There may be a charge for a print version. However, currently, RFJ distribution is online only and free of charges.
3) It is not necessary to register with the RFJ to read and share its content.
4) We invite readers, libraries, and other institutions to share and reuse the RFJ content to democratize access to scientific-legal knowledge.

IMPORTANT: The authors own the copyright without restrictions.

 

DIGITAL REPOSITORY/ARCHIVE

The RFJ allows libraries to create permanent archives of the journal for preservation and restoration purposes. In addition, this magazine uses different national and international repositories, such as Google Scholar among others. And the Institutional Repository of Pontificia Universidad Católica del Ecuador - PUCE (Ecuador) digitally archives and guarantees indexing at the same time.

 

CONFLICT OF INTERESTS

The authors must declare that they do not have any potential or real conflict of a financial, personal or any other type with other persons or organizations in the following two years after submitting the article, which may negatively influence the work carried out. See the form "Conflict of Interest" in the Open Journal System.

 

CHANGES IN THE AUTHORITY

It refers to the addition, removal, or re-accommodation of the order of the authors. Before the article is published, the author for correspondence can request the Editor, add, remove, or modify the order of the authors. You must indicate the reason for making the modification and send a written communication signed by all authors certifying that all agree with the modification. In the case of addition or removal, the written communication must include confirmation by the author (s). Once the article is published, no addition, deletion, or modification in the order of the authors is accepted.

 

COSTS OF PROCESSING AND SHIPPING OF ITEMS

The RFJ is a free publication. The RFJ does not charge for the submission, evaluation, and publication of the submitted articles. The publication does not generate any cost for authors and readers since the Pontificia Universidad Católica del Ecuador - PUCE assumes the expenses related to editing, management, and publication. The evaluating peers do not receive any economic compensation for their valuable contributions.

 

DECLARATION OF GOOD PRACTICES

As mentioned in the Declaration of Ethical Principles (Code of Ethics), the RFJ is committed to high standards of ethics and good practices in the dissemination and transfer of knowledge, to ensure rigor and scientific quality. That is why it has adopted as a reference the Code of Conduct that, for editors of scientific journals, has established the Committee on Publication Ethics (COPE: Committee on Publication Ethics), which highlights:

 

Obligations and general responsibilities of the editorial team

The RFJ commits to:

• Join efforts to meet the needs of readers and authors.
• To strive for the continuous improvement of the magazine.
• Ensure the quality of the material that is published.
• Ensure freedom of expression.
• Maintain the academic integrity of its content.
• Prevent commercial interests from compromising intellectual criteria.
• Post corrections, clarifications, retractions, and apologies when necessary.

 

Relations with authors

The RFJ is committed to ensuring the quality of the material it publishes, informing about the objectives and standards of the journal. The decisions of the editor to accept or reject a document for publication are based solely on the relevance of the work, its originality, and the relevance of the study in relation to the editorial line of the journal.

The journal includes a description of the processes followed in the peer evaluation of each work received. It has a manuscript submission manual for authors in which this information is presented and is updated regularly. The right of authors to appeal editorial decisions is recognized.

The editor will not modify his decision in the acceptance of shipments unless irregularities or extraordinary situations are detected. Any change in the members of the editorial committee will not affect the decisions already made, except in exceptional cases where serious circumstances converge.

 IMPORTANT: When applying for articles, authors must indicate their ORCID code.

 

Relations with evaluators

The RFJ makes available to the evaluators a manual for the evaluation of manuscripts about what is expected of them. The identity of the evaluators is always protected, guaranteeing their anonymity.

 

General aspects of the peer evaluation process

The RFJ guarantees that the material sent for publication will be considered a reserved and confidential subject while it is evaluated (double-blind).

 

CLAIMS

The RFJ is committed to respond quickly to complaints received and to ensure that dissatisfied claimants can process all their complaints. In any case, if the interested parties fail to satisfy their claims, it is considered that they are entitled to raise their protests to other instances.

 

PROMOTION OF ACADEMIC INTEGRITY

The RFJ ensures that the material it publishes conforms to internationally accepted ethical standards.

 

PROTECTION OF INDIVIDUAL DATA

The RFJ guarantees the confidentiality of the individual information (for example, of the professors and/or participating students as collaborators or subjects of study in the presented investigations).

 

Follow up of bad practices

The RFJ assumes its obligation to act accordingly in case of suspicion of bad practices or inappropriate behavior. This obligation extends to both published and unpublished documents. The editor will not only reject manuscripts that raise doubts about possible misconduct, but also consider themselves ethically obligated to report alleged cases of misconduct. From the journal, all reasonable efforts will be made to ensure that the works submitted for evaluation are rigorous and ethically adequate.

 

Integrity and academic rigor

Whenever there is evidence that any published work contains important inaccuracies, misleading or distorted statements, it must be corrected immediately.

 In case of detecting any work, whose content is fraudulent, it will be removed as soon as it is known, immediately informing readers as well as the indexing systems.

 They are considered inadmissible practices, and as such the following will be reported: the simultaneous sending of the same work to several journals, the publication duplicated or with irrelevant changes or paraphrasing of the same work, or the artificial fragmentation of work in several articles.

 

Relations with the owners and editors of magazines

The relationship between publishers, publishers, and owners will be subject to the principle of editorial independence. The RFJ will always guarantee that the articles are published based on their quality and suitability for the readers, and not with a view to an economic or political benefit. In this sense, the fact that the journal is not governed by economic interests and defends the idea of free access to universal and free knowledge facilitates this independence.

 

CONFLICT OF INTERESTS

The RFJ will establish the necessary mechanisms to avoid or resolve possible conflicts of interest between authors, evaluators, and / or the editorial team itself.

 

COMPLAINTS

Any author, reader, evaluator, or editor can send their complaints to the competent bodies.

 

ENDOGAMY POLICY

From the fifth number, the members of the Editorial Committee, Editorial Management Team, Editorial Board, and External Evaluators may not publish in the RFJ. For previous issues, members of the Editorial Committee limited the publication of manuscripts to one (1) by volume, when the editor is the first author of the article and two (2), when he is a secondary author. For the same author, the limit was one publication per number, that is, a maximum of 4 publications per volume. However, publications for authors affiliated with the Pontificia Universidad Católica del Ecuador - PUCE will not exceed 30% of the total.

IMPORTANT: As indicated, the RFJ complies with a strict inbreeding prevention protocol (introduced in compliance with general recommendations/policies of the SENESCYT). For this reason, the following cannot participate as authors: 1) the authorities of the Faculty; 2) those who have held a managerial position within the academic unit (Fac. Of Jurisprudence), and 3) those who have held the responsibility of the coordination of research and/or publications of the academic unit (Fac. of Jurisprudence).

 

DIGITAL PRESERVATION POLICIES

The RFJ complies with the policies and guidelines of the Information Technology Directorate and the Pontificia Universidad Católica del Ecuador - PUCE General Library System.

 

GENDER EQUALITY

In a cross-sectional way for all its organs, processes, and products/sections, the RFJ tries to keep it below 50%.

 

LEGAL ANNOUNCEMENT

In accordance with the legal protection provided by Article 118 of the Organic Code of the Social Economy of Knowledge, Creativity, and Innovation (Ingenios Code) from number 1 to number 6 of the journal, the original format of the documents/articles submitted has been respected.
