The Crime of Aggression: Non-Governmental Actors in the Armed Conflict between Russia and Ukraine.

Abstract
Since the incorporation of the "crime of aggression" into the Rome Statute of the International Criminal Court, there has been uncertainty about the scope of the international crime. It is a crime whose active subjects are political and military leaders; however, as scenarios have arisen in which its applicability and scope are debatable, the purpose of this text is to analyze the possibility of having non-governmental actors as active subjects of the crime. For this purpose, the international dimension existing in the crime of aggression will be analyzed. Likewise, the historical treatment given to this crime, the procedural rules on jurisdiction and the case study of the situation between the Russian Federation and Ukraine in the new political tensions will be briefly discussed. Finally, some legal conclusions are presented on the possibility of having non-governmental actors as active subjects of the crime of aggression in the international legal system. In order to achieve this, the doctrine that would allow understanding a broader scope of the crime of aggression is carefully analyzed.
