Crisis Carcelaria en Ecuador. Desafíos jurídicos y sociales para la reinserción carcelaria en Ecuador

La crisis penitenciaria en Ecuador ha puesto en evidencia profundas falencias en el sistema de justicia y en las políticas de rehabilitación social, convirtiéndose en un fenómeno que trasciende lo jurídico y compromete la estabilidad política, la seguridad ciudadana y la cohesión social. Los episodios de violencia en los centros de privación de libertad, las limitaciones institucionales y la ausencia de políticas sostenidas de reinserción plantean urgentes interrogantes sobre el rol del derecho, el Estado y la sociedad frente a la privación de libertad.


Esta edición busca fomentar un análisis crítico e interdisciplinario que examine los orígenes, dinámicas y consecuencias de la crisis carcelaria en el país, así como las alternativas y buenas prácticas para enfrentarla desde una perspectiva jurídica, social y política.

In this issue of the Faculty of Jurisprudence Magazine (RFJ), we aim to open a space for critical reflection on the tensions between human rights protection and international investment arbitration. In an increasingly interconnected global context, domestic decisions of States—including those made by their courts in defense of public interest or fundamental rights—may come under review by international courts in disputes involving foreign investment.


This phenomenon, known as international commercial arbitration or investment arbitration, can result in domestic judicial decisions aimed at environmental damage remediation, protection of vulnerable communities, or guaranteeing social rights being challenged by foreign investors who perceive their interests as affected. This poses a complex scenario of confrontation between state sovereignty, corporate responsibility, and the effectiveness of international dispute resolution mechanisms.


Through the articles in this issue, various paradigmatic cases, legal instruments, and doctrinal perspectives are analyzed, highlighting the need to reconsider the limits and scope of international arbitration in light of the imperative to protect human rights. The magazine thus invites the academic and legal community to an interdisciplinary dialogue aimed at fostering a more balanced and just approach to resolving disputes between investors and States.

The Journal of the Faculty of Jurisprudence (RFJ) of the Pontificia Universidad Católica del Ecuador is a publication that adopts Open Science guidelines. Therefore, it is a continuous and biannual scientific publication (January-June) (July-December) published by the Publications Center of the Pontifical Catholic University of Ecuador (EDIPUCE: https://edipuce.edu.ec/revistas /) and under the auspices of the University Research Directorate (https://www.puce.edu.ec/investigacion-puce/). The journal aims at national and international teachers and researchers interested and committed to generating and sharing openly and ethically scientific knowledge of quality and global impact.

The Journal Faculty of Jurisprudence (RFJ) is a biannual digital scientific publication of the Pontificia Universidad Católica del Ecuador, Faculty of Jurisprudence. It constitutes the Second Period of the journal initially published in 1999. It deals with issues from an exegetical, multi, and transdisciplinary perspective. It is dedicated to the critical analysis of national and international law issues in all its areas. It includes original articles (research, review, analysis, according to their degree of complexity and contribution) and alternatively abstracts of research, book reviews, research notes, miscellaneous, original, and informative reports and translations. The selection and evaluation of the documents are carried out by at least two external specialists according to the << double-blind >> methodology, which maintains the anonymity of the authors and evaluators. Therefore, the articles selected for publication will have: a) passed a preselection and review by the editorial team; and b) complied with the review as mentioned above system.


Therefore, it is a continuous and semi-annual scientific publication (January-June) (July-December) published by the Publications Center and under the auspices of the Research Directorate of the University. The continuous publication modality closes on June 30 and December 31 of each year. However, the RFJ is open to receive articles throughout the year. Its emphasis is the field of the legal (understood "prima facie" in a theoretical sense) and its relationship with other disciplines, knowledge, and sciences. It can use the "special thematic" system in any of your calls. RFJ is included in the catalogs:
